1 - Presentation
These general terms and conditions apply to all persons registering for a Poker tournament organized by a casino of the Lucien Barrière Group or Société Fermière du Casino Municipal de Cannes (SFCMC) Group. Registrations are done online at the website ?www.poker-barriere-inscription.com? or in the organizing casino.
2 - Conditions
2.1 - All registrations on this site or in a casino to participate in a poker tournament are restricted to natural persons of legal age not subject to any measures of exclusion. In consequence the following are excluded from participating in tournaments: minors including those declared legally emancipated, persons prohibited from gambling, persons subject to a measure of exclusion by casino management or a voluntary restriction.
2.2 - All registrations online or in a casino are limited to one person per tournament. Registrations to participate in a poker tournament are nominative and as such are strictly personal and nontransferable.
2.3 - Registration implies payment of organization and registration fees in advance either online or at the organizing casino. All uses of a bank card in the name of a company or a 'corporate' card for such payments are strictly prohibited . All payments made on the website are fully secured through a SSL terminal by the bank Société Générale. All payments are made in euros.
2.4 - The registration will be validated by the organizing casino on the day of the tournament. Upon the day of the tournament, the person registered must come to the casino with a valid ID document. The casino will then issue a document containing civil status data and the address provided when registering online. The casino will then check the identity to ensure that it is consistent with the civil status data indicated in the document and that the person in question is not subject to any of the measures listed above in paragraph 2.1.
2.5 - After this verification procedure, if the registration is valid, the casino will issue the registered player a receipt representing an admission card to participate in the tournament on condition that the player signs the document duly completed issued by and returned to the casino thereafter.
3 - Rejection of participation for non-compliance with measures of prohibition
The casino will retain the organization and registration fees of all persons having registered with payment online for a poker tournament when subject to measures of prohibition listed in paragraph 2.1 as a penalty charge for the prejudice incurred.
4 - Cancellation by the player
4.1 - Only a cancellation of a registration when the organizing casino has been notified in writing 15 days before the beginning of the tournament will qualify for the refunding of organization and registration fees. Any other cancellations of a registration after this date (i.e. 15 days before the beginning of the tournament) or in the case of failure to come to the casino to obtain a participation, the casino will retain, except in cases of force majeure, the organization and registration fees as a penalty charge for the prejudice incurred. However, in the event of a case of force majeure that is duly justified, occurring before the remittance of the tournament participation receipt, the organizer will refund the player the registration and organization fees .
4.2 - The player who shall be qualified for a poker tournament following another tournament qualification in a Barrière casino may request to be refunded for organization and registration fees for the poker tournament for which he or she was qualified provided that these were already paid. The winnings of a qualifying tournament cannot be claimed in cash by the winners. If a player is unable to participate in the tournament for which he or she has qualified, the tournament director may propose postponing his or her qualification for one or more tournament's according to the amount of the commitment. However, in the event of a duly justified case of force majeure, occurring before receipt of the participation receipt for the tournament in which the player has qualified, the organizer will refund the registration and organization fees to the beneficiary.
5 - Modifications
5.1 - Tournament dates and times may be modified or cancelled by the casino director up to 72 hours before the beginning of the tournament.
5.2 - The Casino reserves the right to modify at any time all or part of these general terms and conditions. In such cases, persons registered shall not be entitled to request any damages or compensation.
6 Conduct of the tournament
The Texas Holdem Poker tournaments for which registrations are made will be governed by regulations in force for this type of tournament. These rules are completed and further specified by the rules of the tournament to which all participants adhere.
7- Rights of personal portrayal of the participant (personality rights)
The tournament is subject throughout its duration of images captation of the event and, in particular, of its participants by all means (photos, videos...).
All participants in a tournament organized by a company of the Lucien Barrière Group or SFCMC Group authorize the company or any person it designates to act in its place, to photograph and film them during the tournament and grant Groupe Lucien Barrière and SFCMC and all of their subsidiaries the right to use, directly or otherwise, their sound, image and name for all purposes including notably advertising and commercial purposes and events related to the gaming activities of said companies . The rights transferred over the image include the right of reproduction, adaptation and communication to the public of their image on any medium including notably books, newspapers, magazines, brochures, catalogues, guides, agenda, displays, postcard collections, photocopies, and in any electronic or video form including notably on CD-Rom, CD-I, CD-photo, DVD, Blu Ray, internet, intranet, social networks, streaming platforms or any other media existing now or in the future and through any process existing now or in the future. Use of these aforementioned rights may be exercised directly by the company organizing the tournament or by Groupe Lucien Barrière or SFCMC and/or indirectly by the company to which the subsidiary organizing the tournament has appointed to act in its place or to transfer said benefits notably by sale, lease, exchange or loan. This authorization is granted without valuable consideration both in France and in other countries for a period of five years from the date of the signature by the participant of the participation bulletin.
8 - Personal data protection provisions
Information collected through the registration process are automatically processed for the tournament registration participation. Information thus collected is destined for companies of the Lucien Barrière Group and SFMC Group. Subject to consent granted by participants or in the absence of objection formulated on their part, companies of the Lucien Barrière Group or SFCMC Group or their partners may provide participants with information about their offers and services. In compliance with the French personal data protection act (loi Informatique et libertère, participants have a right to access, correct, and delete information concerning them and a right to prevent being sent commercial canvassing messages from companies of the Lucien Barrière Group or SFCMC Group. 9 Disputes
For any disputes arising in connection with the interpretation of these terms and conditions and their consequences, the parties undertake to reach in priority an out-of-court settlement. If an out-of-court settlement cannot be reached, the dispute or litigation shall be submitted with courts of competent jurisdiction.
